The Polokwane High Court delivered a significant judgement on Thursday, 29 February 2024, imposing a lengthy twenty-three-year prison sentence on Semosa Matome Emmanuel (39) for the brutal murder of his brother and an Advocate in 2022.
The court proceedings revealed a chilling account of the events that unfolded on January 8th, 2022 at his father’s residence in Sekakeni village, Botlokwa policing precinct. Upon encountering his brother and a lawyer engaged in a discussion on family inheritance matters, the accused abruptly brandished a firearm and fired several shots.
Tragically, his brother and the lawyer succumbed to their injuries on the spot, while his sister narrowly escaped unharmed from the chaotic scene.
The victims were identified as Semosa Mokgalabje Jacob (56) and Advocate Ramakadi George Phoshane (52).
Following the incident, the police opened two counts of murder and possession of firearm and ammunition, initiating an investigation led by Detective Sergeant Albert Mariba. Subsequently, the suspect surrendered to the police leading to his arrest and subsequent trial and conviction.
He was found guilty of all the charges brought against him and sentenced as follows:
* Count one (1): murder, twenty-three (23) years imprisonment.
* Count two (2): murder, fifteen (15) years imprisonment.
* Count three (3): possession of firearm, five (5) years imprisonment.
* Count four (4): possession of ammunition, three (3) years imprisonment.
The sentences will run concurrently. He was also declared unfit to possess firearm in terms of firearm act.
The Provincial Commissioner of the South African Police Service in Limpopo, Lieutenant General Thembi Hadebe has welcomed this significant judgement and sentencing by the court. The South African Police Service reiterates its commitment to upholding justice and ensuring the safety of all citizens. “We commend the diligent efforts of the investigative team and affirm our resolve to pursue and prosecute offenders to the fullest extent of the law”. said the Provincial Commissioner.
